SAME SEX (GAY) NON-RESIDENT DIVORCE IN CANADA

If you are in a same-sex marriage that was performed in Ontario, you can file for divorce in Ontario if only if a divorce cannot be granted because your home country does not recognize the validity of the same-sex marriage.

Our fee for a joint (both spouses sign) application under the Civil Marriage of Non-residents Act is $450 + 13% tax. The court’s mandatory fees total $437. There is a 4% surcharge if paying the court’s fees with a credit card or PayPal. So, the overall total would come to C$964.

We do not give a legal opinion or advice that your home state is “a state where a divorce cannot be granted because that state does not recognize the validity of the marriage” – it is your responsibility to determine this with a local lawyer before engaging DivorceFile.ca to process your divorce under the Civil Marriage of Non-residents Act.  We are not responsible if a divorce obtained under the Act turns out to be invalid because you could have gotten a divorce locally.
